Not advocating for Max here, but I kind of like the idea of superman not having a "no kill rule" in his code, because it makes his reluctance to kill more meaningful. He doesn't refuse to kill because he's afraid of never stopping or because he doesn't want to be considered a vigilante or because he respects human laws (he does, but that's a complementary reason). The way he sees it, every life has worth. Even a scumbag like Black or a mass murderer like Luthor mean something, even if they must be contained or beat to a pulp. It isn't a rule, it's his genuine will.
