Thing is, Someone made a a Web comic about Snowflame, only stopping it way later because they were juggling it & their job, it got coverage & DC doesn't bar an eye.
Meanwhile these guys basically did the same thing with an Obscure Marvel character, Marvel somehow feels threatened & stops it.
It's like Sega vs Nintendo.
Sega fans do fan projects, Sega doesn't mind, hell even hires them sometimes.
Nintendo fans do the same, they get shut down after the projects is close to finished or just finished, all the hard work for nothing.

Point is, instead of embracing it, they felt threatened about a fan book made about an Obscure character they won't ever use anyway since they depowered him & because Marvel seems to only remember their smaller properties when It's convenient for them to make money. What do they get out of it other than losing a customer, losing a potential employee, another reason to drop them, etc., etc.

It was pointless because who remember Aguila? Fox don't give two shits. I once had respect for Marvel, but as of recent years, I only respect select writers of Marvel, because Marvel as a company is a damn shell only living off the Mouse to make ends meet before it stares down a gun barrel & finally ends it's suffering.

The thing is, Fox probably doesn't have rights for Aguila. Fox doesn't have rights for Squirrel Girl (even if she was still a mutant), and they didn't have rights for Negasonic Whatever, because they exchanged Ego for her (which ironically was a good call).

Another thing is, Fox could very well sue Marvel for Agents of Shield, and the upcoming Inhumans tv show, because these two are very similar to X-Men. They sued Mutant X, which was 100% marvel show for that reason.

Fox, for all their faults, is in the clean. They do good movies (fuck off, I enjoyed Apocalypse, despite the memeing here), and if anything, they will make even better movies, because they will smell the money. Marvel, on the other hand, completely mishandles their properties (GOTG is a shining example of that, it's a pity that they had to make a joke team in order to sell it, because both Valentino's and DnA's run were perfect comic book fun).

The problems are:
-Ike
-Marvel workers not having spine to work it out somehow.

Obviously, when your boss gives a direct order, you have to follow it. But how you follow it, is up to you. And marvel workers chose the laziest, shittiest way to follow it, and they did things they didn't have to do, like making Toro (second Marvel's mutant) an inhuman. Was it really necessary.

The problem is Nintendo is bigger than sega. Nintendo has a reputation as a family product. They are too afraid to damage this by reacting so harsh and controll everything.
Too afraid that it deludes it by not knowing what they smuggle in these games and it prevents that programmers make money with their IP or customers dont buy their games because fan made games are there why buy originals.

And Marvel dont really bat an eye about fan comics as far as i can tell.

No, it doesnt. Its just the possibility and that they have to draw a line. Otherwise someone, maybe DC, could make a spiderman comic and if they go to court, DC arguments that Marvel let the amateurs produce, print and sell a comic. Therefore DC can do this too. Its not likely that DC does that or that they win, but thats still a liability that small companies could try to feed on Marvel properties or produce something that isnt wanted.

No denying difference in company culture and that Marvel is backwards, but these guys made their biggest mistake with all the official looking shit and logo on their cover. Also, were they making money off this in any way? That part I'm missing... if there was any money at all involved it's really no surprise the legal team came down on them so hard. Marvel's misconception is that this would somehow loose them money when in reality it helps generate interest, predict trends in what readers like, and gives the next generation of talent a place to develop and get noticed.

In Japan there's an entire unlicensed fan comic industry, and it only strengthens the rest of the Japanese comic industry.

That said, legal teams in America often feel their hands are tied because of the way American copyright law is written and because the precident is that if you don't actively assert your copyright over your intelectual property, it can erode your claim to control that property in court. Our copyright law really needs to be rewritten but our government would much rather fight over controlling our personal lives to promote their own agendas than being true statesmen serving the people.
