Anur Transyl was post OS. Frankenben was originally taken from Viktor's DNA, a NASA scientist who just so happens to also be a Frankenstein monster. None of his powers are biological nor is he ever referred to as an alien in origin. Ben's omnitrix samples him and does its best to replicate all of Viktor's technological albeit with human elements similar to Ben. Unlike literally every other alien Ben has absorbed, Frankenben is not exactly like his original. He has specific facial features that differ from Viktor and generates a green lightning as opposed to purple.

OS, first appearance of Upchuck, season 4. Grandpa Max is reunited with an old plumber friend in the form of a space alien vixen who Ben thinks is going to take Max away forever. There, she says specifically that Ben was never the intended target for the watch. The end of that episode has Max being the end recipient of the watch which makes sense given his plumber background and extensive knowledge of alien life forms. While Max never knew about the watch and himself being the original target, it was still Max's DNA that was in the watch hence why it mistook Ben and Gwen in the what-if episode for Max

My guess is they weren't sure how to depict it, since Vilgax in every appearance outside the first episode of OS(and a couple flashbacks) is augmented beyond what his species' natural capabilities are, indeed we get no indication that they have any abilities noticeably beyond the human norm
