I'd say tracing is pretty unjustifiable, even when an artist I like does it. So the stuff that's traced, yeah that's theft.
As for the stuff that's not straight up traced, it's more that it adds to a very uncreative whole. The great majority of of what looks cool about that opening is taken from something else.
