You kind of answered your own question.

There's actually more logical argument as for why Stark wouldn't be in jail.

1. Strictly speaking Stark technically didn't do anything illegal to land him in jail, and he did exactly what he said he was going to do; run tests on the scepter. Ultron resulted as a freak accident of those tests (even JARVIS was bewildered as to how he gained sentience) and Ultron was a conscious, self-determining being that made the individual choice to do what he did. You don't go to jail for something your kid has done, for example.


2. Stark was actually the biggest factor in saving the world from Ultron. His idea stopped the doomsday scenario from reaching completion, and localizing the damage to a small, poor city and the surrounding area. Don't forget, he flew a nuke through a wormhole and saved New York almost at the cost of his own life. That probably won him a lot of brownie points to spend.

3. Whether you like him or not, Stark GETS SHIT DONE. He's one of the Avenger's heaviest hitters (possibly THE heavient hitter in Veronica) and unlike the others, he can think of unorthodox solutions to complex and pressing situations. He straight up single handedly brought multiple terrorist organizations and private armies to their knees by his lonesome even before his tenure as an Avenger, and there was a point in time where America couldn't wait to sic Iron Man on their latest actionable target. You don't put competence like that in prison for charges in the interest of a vague sense of punishment for the man that was actively involved in the solution to the problem, you put his ass to work for you.

A better question is how the fuck is Wanda not in prison? She did a lot worse than Stark, and not accidentally.

Also technically, Stark didn't create Ultron. Stark tried to create his own AI, using Jarvis to run a preset list of combinations; the AI from the staff that became Ultron then awoke, settled itself quite nicely into the Stark suits, killed Jarvis, and began causing havoc.

TL;DR Ultron already existed in the staff, Stark merely used the staff as a template, staff AI proceeds to escape.

Stark is a flawed human being like all of them, though he does also have the advantage of being human and rich.

Thor nearly started a catastrophic war between the Frost Giants and Asgard, Steve is stubborn and lives in the past, Wanda acted upon anger without understanding what she was doing, Natasha has done a ton of bad shit, Banner is part monster, Sam is anti-authority.

I get the impression Tony is the only active Avenger as we enter Infinity War, perhaps Steve is active as a vigilante, but the rest have likely all quit.

The implication by Marcus and McFeely is that Stark is the only one concerned with the impending threat. Everyone else has disbanded.

The Avengers have been breaking laws left and right well before and after Ultron. The world's governments had given them a pass up until the Lagos incident, and even then it's not "We're going to punish you for everything you did" but "We'll let your past actions slide, but not any future ones." It's a blank slate.

He didn't conspire in any way WITH Ultron, he didn't sit idly and let Ultron get away with shit...

Ultimately Tony fought to the nail to stop Ultron having accidentally created him.

There's no crime in accidentally giving birth to a criminal.

Simply put, with a mind as extraordinary as his, you either want it on your side or you want it deader than dead. Trying to kill him has clearly been shown to be easier said than done and failing gets you a pretty terrifying enemy for your troubles. Having him believe he's your ally and you are his is clearly the superior choice here.

Even disregarding all of that, what's to say you could even *keep* him imprisoned for any length of time? While more than capable of getting out of anything anyone could come up with to keep him locked up, he's also friends with a god, a raging natural disaster, a super-soldier and 2 super-spies.
