Yes, he'd be deemed problematic even though he really isn't. He's just a good villain and he's shown subverting about as many stereotypes that he plays straight (no homophobia, likes non-hip hop music, intelligent, successful, a threat to Frank unlike the dozens of other black wannabe gangsters Frank wastes). He's about as racist as Omar from The Wire but today's audience would only be able to see the problematic nature.

But Punisher is a series where it should be told straight up with no fear of consequences or not at all. Obviously there are consequences with the current outrage culture of people who don't actually read comics, but if you can't have a good villain because he's too stereotypical in Punisher of all things then it'd be better not to have it at all.
