IIRC Nolan was planning a "continue a Two-Face/Joker plot" approach early on, no idea what would've survived or not later, and if his interest in a third movie died down naturally or due to Ledger's demise. If filming for TDK was finished by then, then Harvey's fate was already sealed.
To keep things fresh I'm sure WB would've made him insert new villains regardless (on top of milking Ledger), so more or less it'd be TDKR but the Joker plays a dragon-role midway through after Bane takes over Gotham.
I imagine he'd be playing judge instead of Crane.

Same thing as it was with him dead, only there would have been a tacked-on sub-plot of him being the key force behind the criminals taking over Banetopia, formerly Gotham. It probably wouldn't have saved the movie from making no sense.
It would have undoubtedly been better.
