As for the studios themselves, Deadpool referencing popular movies is one thing (and was, I can assure you, run past multiple lawyers, multiple times); Deadpool attempting to draw on the popularity of an existing franchise to boost its own is another.

The fact is they won't even allude to Thanos. Marvel has spent 4 years producing Infinity War and - get this - has an actual contract clause with FOX which means they get to approve FOX-Marvel scripts. Normally it gets waved through. If FOX look like they're trying to trade on Marvel's popularity by casting Brolin for Deadpool the year his big Marvel movie (and one of Marvel's most expensive and plot-important movies in years) happens, Deadpool 2 just won't come out in 2018. It'll get pushed back and back and when FOX think they're losing money by not releasing, they'll sue, and they'll lose - because fair use doesn't enter into it with that kind of contract. It's not a free speech issue - it's a marketing issue, and Marvel are the ultimate owners of the product with a very solid set of do's and don'ts in their contract.

The reason for Spider-man rebooting were for reasons not tied to the franchises staying power and more extenuating circumstances, most specifically for the Raimi series. There's a reason the Spider-man films on average did double what the X-men films have done, and no its not because Spidey was more popular at the time. Coming into the 2000s, the X-Men were the more popular franchise. It was Raimi's films that soared the former into mega stardom, while X-Men slowly floundered during the its film series period.
