Tyke is not a self respecting hero, also he made the call to form an uneasy alliance in order to kill the monster faster or maybe because he wasn't confident enough the champions could take them on their own, if he had told they're gonna jail em they'd had left or fight them and that'd have made it harder to beat the monster. Also in order to jail them they'd waited for shield or take them to a superhuman prison, and that'd been impossible since the earth is under monster attack and they're going to LA to kill the big eyed monster.
