That has been explained in both books. Harley isn't actually a prisoner, they kidnap her whenever they want her for a mission. Apparently keeping her locked up is a hassle as they don't want to get targeted by people looking for her. As it has been portrayed she is more or less a willing member of the squad, i think at one point Waller threatened to blow up her head if she told anyone else in the squad that she wasn't a prisoner,
