They can request permission to land and apply for asylum. If their needs can be met, Earth can probably find a place for them in return for some of the alien tech that their ship is made out of.

But really, just letting aliens show up unannounced whenever is super dangerous. What if they were fleeing a plague and they brought it with them? What if they are criminals on the run from spacelaw and looking for a place to lay low?

If there is a legitimate crises and Earth is the closest place they can flee too, WE NEED TO KNOW THAT TOO. Because that means something really bad is happening right next door to us, and we won't know about it unless someone tells us instead of sneaking in and staying quiet.

The weird thing is that the chitauri showing up in Captain Hydra seem to be some off-shoot race from the ones that were appearing in Nova. For one, they're using the Ultimate Chitauri design instead of the MCU/616 Chitauri designs, second off, they're basically a giant swarm of cosmic bugs (dimwitted creatures that swarm a planet en masse looking for a Chitauri Queen) making the comparison to the annihilation wave not without merit.
