The only reason Tony isn't a war criminal is because he's never actually been in an official war, so the argument that siding with Bucky is wrong because war criminal isn't really that strong.

Cap was basically put in a situation where he had to either choose justice or compliance.

If he chose justice, he'd basically be leaving his bonds with the Avengers behind and putting himself on the chopping block as a fugitive to the law.

If he chose compliance, he'd put himself in a situation where he and the rest of the Avengers would basically become hit squads sent to who knows where to fight who know what, even if they're needed elsewhere or can't get approval in time.

Worst part, even if he absolved Bucky of blowing up the United Nations building, he'd still have to answer for the shitloads of political killings he's made over the years, including the death of Stark's parents.

There really weren't many ways Cap could've won this.

no he wouldn't have because in the movie there is a book of activation codes for multiply sleeper agents there is also a base where those very sleeper agents were frozen he could have easily got him absolved of all of this if they would have gotten a real psychiatrist to test him

there are real cases of a kidnap victim working in the interest of their kidnapper even going so far as to defend them and getting proper help why not with him a war vet that was abandoned or thought to be dead he was just MIA not KIA
