One of the short stories in this was about a new Arkham employee trying to arrange this (Joker even admits to being slightly impressed by the guy's tenacity).

Anyway, it obviously didn't go well.

What if Joker's back story and personality is hard to pin down because a lot of people have been the Joker? Like there was the red-hood guy who may have been the first, and there was the chemical engineer who created the Joker gas probably an employee of Ace Chem, the Mafia styled gang leader, the brilliant psychopath (who tainted his psychiatrist), the excellent hand to hand fighter whom we see go toe to toe worth the bat. Okay, I get that he could have been a genius before becoming the Joker, but nothing explains his hand to hand fighting skill. He is an extremely good Knife fighter that barely feels any pain, always on the equivalent of Coke and meth times eleven. And he DOESNT HOLD his own against Batman, that complain is from people that never has touched a batman comic, the whole deal of most of batman enemies is that you can't just go and beat them up since what you have to do is stop their plans and usually just punching them doesnt solve anything.

The joker can land one or 2 punches on Batman, but he can also do it to midnighter or cass, DC tier martial artists can't predict him, they can easily kick his ass and will always easily defeat him, but he will land one or 2 hits, weak as fuck hits, but hits regardless.

Insanity is a legal term, not a psychological one. A halfway competent prosecutor could get Joker a death sentence in his sleep. Like >>82792691 said, Joker can clearly form mens rea and understands the consequences of his actions, so he doesn't meet most traditional definitions of insanity.

This is not even a legitimate excuse.

The Joker is NOT an American citizen since he can't prove his identity. Even if he were one, he's a bloody TERRORIST. He's the literal definition of terrorist.

He's supposed to be tried in a Federal Court and at the least sent to Guantanamo but in all likelyhood recieve a federal execution.

If they found Osama in Gotham and he proved he was insane, would they lock him up in Arkham?

How the fuck do they even put him in Arkham, if they (legally speaking) have no idea what country's citizen (if any) he is?

I'm fairly certain it's illegal to incarcerate someone who isn't your own citizen, or the citizen of a country with whom you have a legal agreement.


It's not just that he's supposed to go to Guantanamo (Hell, I think Guantanamo itself might not be the worst. I think it still counts as an American incarceration facillity as opposed to a neutral one.) It's absolutely illegal for him to be incarcerated anywhere else.

I really fucking doubt that Arkham is some sort of UN approved neutral facility where you can stick international terrorists of ambiguous legal standing.
