This means Kombucha sold in Texas grocers can't have any live organisms, due to ongoing fermentation from the organisms increasing while they are alive. This means all the Kombucha you buy in Texas grocery stores is dead. That's right -- the bottles of Kombucha you buy on Texas grocery store shelves contain nothing but dead organisms.

If they were alive the ABV would go up as the fermentation process continued. Thus, they have to be shelved until dead, then measured for ABV, THEN shipped to stores.

Blame Texas lawmakers, not producers! Texas is the only state like this!

Fermentation is a repeatable algorithm though. You could easily show that by having a low enough content of sugar the abv will never rise above x percentage. This makes me question your claim.

Texas law doesn't allow for that. Fermentation is one of the most understood biological processes known to man. We here in Texas think it's due to competition and lobbying from traditional beverages, until they have bought up enough established Kombucha brewers to lift that ban.
