Are these startups and blockchain branch companies just playing semantics now to get around the SEC or what is the deal. Can I participate in a crowdsale or a presale even though I can't participate in an ICO?

the purpose of exluding US investors is so that the blockchain company does not have to register their token as a security with the SEC, becuase that's retarded

no one can actually stop you from investing or buying these tokens unless there's KYC for every transaction

so I'm gonna buy Ethbet and so on anyway regardless

So yeah, I get them leaving out Americans because of the SEC situation. Buy I have seen some companies to "Presales" or "Crowdsales" where it acts a fundraiser and then they "gift" you tokens for donating. An obvious work around. Or am I reading this wrong?
