So I lost my job today because of alleged sexual harassment.

The stories and information posted here are artistic works of fiction and falsehood.
Only a fool would take anything posted here as fact.

So I lost my job today because of alleged sexual harassment.

>I was texting an employee about non-work related stuff
>apparently her boyfriend saw the texts, though they weren't inappropriate, and flipped his shit.
>she lied and said that she didn't want me texting her to him
>got carried away and is accusing me of sexually harassing her, though nothing remotely inappropriate happened.
>called into my bosses office and was fired today.

I still have access to this girl's bonus point section that the entire corporation can see.

Any recommendations? I'd like to go out with my head held high.

I do like my boss, and her hands are tied.

What I really want to do.

This is the real problem.

If it was really innocent? Contact a Lawyer and make bank.

Sue the cunt who lied, your boss. and the company. EACH, SEPARATELY. If you sue them as a group the company will pay all costs and you will have a long fight. Guaranteed the cunt and your boss will settle which will pay for the big pay day.

In my country you could sue they all in one even though it would be better to sue separately. But they would be sued for different things. She would be sued for lying and destroying your job; your boss for firing you without hearing you and your company for worker rights anyway.

Right but then the company would cover all the costs and the battle would rage on for years costing you fuck tons, before you ever saw penny one. By suing separately the boss will settle first and you can use that money to continue to pay the lawyer to ream the cunt and the company. With no real risk to your personal finances.

Same thing happened to me. You're fucked. Suing is hard if you're an at will employee. Also it will be very hard to find another job if you're involved in a lawsuit against a former employer. Try and get in writing that you resigned and make sure they talk about the circumstances to anyone. Move on, don't look back and leave graciously. It's not the end of the world by anymeans.

If what you said is true, your employers jumped the gun when they fired you. There is a process to be followed in first establishing that sexually harassing behavior exists, that it was identified to the accused harasser, and that the harasser continued behaving in the ways he or she was told to stop.

If what you said is true, your best recourse would be to find a labor lawyer in your area who has an activist streak to him or her. You probably also have cause to file complaints of your unjust treatment with the EEOC and its counterpart in your state.

I told her off. Fucking bitch.
>>
No lawyer would go near this and whatever you fucking do, leave the girl and the company alone. Move on, or you will get a cease and desist letter from the corporate attorney and you definitely don't want it to get into the criminal law arena. Trust me. I've been through this. Move on.

Why didn't you report this before she got to your boss? Find a lawyer to sue over "wrongful" termination and any interpreted and implied "sexual" harassment are lies. You should not have been the one to get fired.

Fuck, people. Don't have ANY contact with any coworkers. Ever. Stupid shit like this happens.

This isn't true. This only happens if they are guaranteed they are going to make money, like insurance cases or cut and dried cases like someone hurting themselves on a wet floor. In OP's case which could go both ways, I'd bet they are going to ask for 5k just for "discovery"

In civilised countries there are laws to protect workers for this. Where i live employers have to prove that something happened and that it was urgent to fire the employee. Fire immediately is only allowed with things like fraud, theft, assault, endangering coworkers or being drunk at work. In your case the judge will cancel the dismission, making you officially employed again. The employer will than probably put you out of active service and start a normal procedure to fire you. He has to have a file with all your misbehaviour and warnings that are given to you. If the employer can't handle a file like that to the court, the normal procedure will be cancelled too. Then your boss is forced to settle with you to get rid of you or pay untill the end of your contract.
>>
>>743886456

You hugged her, it was witnessed, she was in an emotional state, there is precedence, plus the chat record backs up her claim of continued harassment whether you feel it was a non-event, means little.
>>
>>743889632
But hey. This is only in civilised countries. But you seem to live in some third world shithole, so there's probably nothing you can do. So goodluck!

OP seems fishy. I don't think we got the whole story. I bet he's a creep and those texts were super inappropriate. You can't just claim sexual harassment out of nowhere without basis. Your attempts to put your dick in your coworker were getting annoying and they finally got texts to prove you're a creep.
>>
>>743884016
sue for wrongful termination. if you have proof the ball is in your court
>>
>>743887982

But:

1. Did you make physical contact (hugging) that was witnessed?

2. Did you repeatedly text the woman, about "non-work" items?

This company might have decided to be proactive and seperate themselves from OP in advance of a lawsuit from this bitch, suing the company
>>
>>743889871

plus the witnessed physical contact
>>
>>743884016
if OP isn't lying he could just sue
>>
>>743884016
Did she press charges? I was charged with sexual harassment back when I was 18 or so on a girl that was 17 and almost got a sex offender placement as well. Don't fuck around when it comes to sexual harassment. It's her word against yours and in courts, they tend to listen to the women 9 times out of 10. Trust me, kid.
>>
>>743889632

Most US states have "at-will" clauses which means you can be separated at any time without explanation.
>>
>>743889279
Where are you getting this 5k dollar figure from? You think it costs that much for sexual harassment? No, boy.
>>
>>743886272
Not really a thing in the states if you live in an at-will state. They can fire you on the color of your tie and get away with it.
>>
>>743886456
Show us the texts.
>>
>>743888304
Well, clearly, OP is a fucking faggot moron so he couldn't help but to try and get his dick sucked by some whore at Macy's or wherever the fuck he works.
>>
>>743890380
In most cases these clauses and laws do not hold water once you go to trial.

Especially if the jobs are skilled or degree related. Certainly not if you have 5 or 10 years with the company.

>>743890470
Don't do this.
>>
>>743884016

OP's best bet is to sign up for https://forum.freeadvice.com/

There is a section for employment law. Its just a forum like this, but with more informed commenters, most are lawyers on there, but you'll get several opinions usually.
>>
>>743889871
Exactly. I've been there done that with sexual harassment. I got charged with a misdemeanor for fucking saying I'd rape a chick. I can't imagine what OP said. Probably tried to fuck her face in the bathroom.
>>
Im a lawyer Show me the texts and I can see how good of a case you got.
>>
>>743885745
This, also keep on record all contact with her, message sent/recieved anything said or done in person right that shit down with dates and times. My only gripe is you accepted the dismissal, make it clear to your boss you intend to fight the decision but do so through a lawyer now.

To fire you without realistic proof of any wrongdoing is against the law, innocent until proven guilty not the other way around.
>>
>>743890346
>her word against yours

In this case:

1. there was witnessed physical contact (hugging)

2. there was repeated texting probably suggestive in nature that went beyond work related communication
>>
>>743890642
Don't do this.
Be smart. Revealing anything on /b/ would prejudice your case.

Go get a lawyer and get the fuck off of /b/.
>>
>>743890550
Fine, at least tell us how many times you texted her, OP.
>>
>>743890725

>>
>>743888988
It's free to talk to one of there is a lawsuit they will take a percentage of the winnings. So what. If this is true LOL and its not then OP could sue and win. Do nothing call a lawyer Tuesday and get the ball rolling
>>
>>743890793
I'm Rand Spear, the accident lawyer. Trust me that I can get OP a large lump sum for being a fucking faggot.
>>
>>743890393

You apparently don't know what a retainer is. But lawyers want their money up front unless this is cut and dried. Since this could go either way, other than a casual office chat, they are going to require to be paid in advance.
>>
>>743890945
They'll do a consultation but OP might end up on probation and jobless.
>>
>>743890978
Yeah I fucking do. I've had to hire a high cost attorney when I got charged with two felonies, pal. So why not take your bullshit legal advice elsewhere?
>>
>>743884016
If you really did nothing wrong, file a wrongful dismissal case.
You'll either get your job back or a hefty severance.
>>
>>743890978
Attorneys often have installment plans where OP could pay them payments. He could be ordered to pay the coworker restitution and damages though so whatever. I don't feel bad for this idiot. When they say workplace romance is off limits, they fucking mean it.
>>
>>743890550

Only if he has sufficient evidence that they fired him for this specific act. Its typical that in the US they call you into the office and say as little as possible with HR present, give you a box, your escorted to your work area and told to collect your belongings. Then they ask for your keys or access badge and walk you to the door. They must provide you with your last checks also.
>>
>>743891207
Also if he was escorted off company property.
>>
It's important to talk to an experienced lawyer if you believe you were wrongfully terminated due to a sexual harassment charge. Several court cases have ruled in favor of an accused harasser if the employer was shown to use the charge as a pretext to get rid of an employee. A lawyer can inform you of your rights and help you understand your choices if you choose to go to court.
>>
>>743891034

I did more than just hug and she did too, we even made out once at one of our company parties.

It all started when I asked her if she liked me and she said 'only as a friend', to which I just started to treat her as a coworker and ignore her shit, she didn't like it and started to insult me. I told her I will report her to HR if she keeps it up and instead of apologizing she threatened me with sexual harassment allegation. All evidence is on email...
>>
>>743891661

Your own family pressed charges on you? You sound like a real douchebag, just like OP. And money did change hands? Yep.
>>
>>743891832
If she has proof that you and her had a workplace romance going on and that you and her had sexual contact, and that you communicated with her and practically threatened her with getting her terminated for her job because you got mad at her, then you're going to have to defend yourself either in front of your department of labor, HR, or court system. However this girl wants to handle this or how they want to.

>>
>>743884016
You have rights on this matter. If you like the job, I would get an attorney. If your story is accurate, then there is no proof of the allegations and you can sue for slander and harassment.

Publicly release a letter of apology to the entire staff explaining the situation and how you felt you were wronged. Explain that you will miss them and have enjoyed your working experience with them and are very upset things ended so wrongfully. Call the bitch out without specifically labeling her. I don't think you can release the text conversation publicly, though, without that being a sueable offense to you. Not sure on that one. But you can make a comment that explains you have proof you did nothing wrong and are pursuing legal action to right it all.

I'm serious about the lawsuit against them though. That is easily a year's salary you could sue for as it defames your reputation and that kind of shit goes on record for your next job to see. You will want to do what you can to clear your record at their expense.
>>
>>743890987
You are either ! Dumb as fuck or B. Dumb as shit. Seriously, explain how the fuck he would end up on probation?
>>
>>743888988
A good lawyer will give you a free consultation and if they think you have a case it won't cost you anything, but they'll take a third of any money you win.

I've sued a employer before for a wrongful termination and that's how it worked for me.

The hell it isn't, dumbass. A major evidentiary issue for the judge is determining whether the texts/emails were genuinely written, sent, or received by the parties and that they contain the full conversation. The key to overcoming this barrier is by authenticating the source of the messages

Just have a free consult with two or three different lawyers. Explain to them your situation and if they all feel like your odds of winning a case are good, find a way to scrape together a retainer and file for wrongful dismissal.
Lawyers keep track of their case wins/losses and so won't want to take on a case they feel doesn't have any legs.
Don't consult just one lawyer though because they can mis-assess like anyone can. Get second opinions.
>>
>>743892887
I warned her in email. Investigation is over and company is not going forward with the allegation. If it was going forward I would receive a letter saying that. In this case, I can see the company is afraid that this woman sues them for not doing enough to protect her from harassment, which is why they let OP go.

>"asked her if she liked me and she said 'only as a friend"

Yet OP continued on with texting suggestively on non-work related communication even after the relationship became toxic.
