Yeah, actually hate speech is protected under the first amendment. If it wasn't KKK rallies wouldn't be a thing. Or Black Lives Matter. Or Westboro Baptist Church. There are relatively few unprotected categories of speech such as incitement (speech that is likely to incite imminent illegal/violent action), fighting words (speech that is likely to cause a fight), and obscenity (this one is pretty vague).

The USSC uses strict scrutiny when evaluating any statute that regulates the content of speech. Which means it is presumed to be unconstitutional unless the gov't can articulate a compelling interest and the law is as narrowly-tailored as possible to meet that interest. That is why so much speech is protected.
