Anyone at any time can be "selected" and ordered to report for examination and induction.

Congress does not need to approve "the draft"

When you join the military by choice, you are joining the selective service first, and the military may choose to hire you if you pass examination.

If you do not pass examination you remain in the selective service, but the reason for you not passing examination will remain on file.
