If the actual person who owns the content asks for it to be taken down, you're supposed to do so. If you say no, they can get a judge to order you to. Bubba the Love Sponge Clem and Heather Clem were friends with Terry Bollea and convinced him to fuck Heather so that they could make the tape and sell it to the highest bidder. Terry was not aware of the camera and did not consent to being filmed.

Eventually Bubba the Love Sponge sold the tape to a rich friend who would have a proxy sell the tape to Gawker. His defense would be that Hogan consented to being filmed and the tape was stolen. It would come down to he said she said, and worst case would pay pennies on the dollar for filming Terry without his consent if no one could confirm the tape wasn't stolen. Gawker would take the hit and at most they could give the name of some crackwhore proxy.

Gawker released the tape for traffic and revenue, believing that their lawyers could argue that Terry Bollea does not have a reasonable expectation of privacy because he is a celebrity, and the tape was of public interest (it is a lot more complicated than this though). As their ace in the hole, they would threaten Terry with releasing the racist rant if he pursued litigation.

Terry probably realized the payday would be worth sacrificing his career and reputation and called their bluff.

Bubba the Love Sponge has settled out of court with Terry Bollea.

Gawker has to pay 115 million dollars in damages to Terry for their invasion of privacy (with punitive damages pending). Albert J. Daulerio (editor in cheif of Gawker) said that it would need to be a child under the age of 4 for him to consider not posting a sex tape, which didn't play well with the jury.

Nick Denton (Gawker CEO) said they are planning to appeal and the jury did not hear all the facts. A few hundreds of millions is just about all of Gawker, so it is very likely the entire company will be liquidated if it doesn't work out.

Bubba the Love Sponge has gone on record stating that all rooms of his house are monitored for legal purposes and he tells everyone about it when they enter. By remaining within the residence, Terry Bollea would have non-verbally consented to being recorded. Terry could have forgotten, or assumed that the recordings would have been deleted automatically after an arbitrary amount of time, which all security cameras do (and Bubba claims that his did).

Furthermore, going on a racist tirade is inherently detrimental towards his reputation whether or not he was being recorded. Even with a reasonable expectation of privacy, he wouldn't have expressed himself in such a way if he did have such obvious concerns about his career and image.

Invasion of privacy claims require both of the following be true:

1. Disclosing private information that harms a person's personal or professional reputation.

2. The information is not of public interest.

Most of this case was about whether or not Terry's sex tape was of public interest. Their argument was that Terry is not actually a celebrity, but that he is playing a character (Hulk Hogan) and that character is the celebrity, and that Terry Bollea the person is not famous enough to warrant public interest.

If it does constitute public interest, then Terry has no cause to claim that Gawker invaded his privacy whether or no he consented to being filmed. However, he would have cause to claim that he was recorded without his consent, and whoever recorded him would face criminal charges.

Assuming Hogan didn't simply 'forget'...Bubba obviously could have been lying about telling Hogan. If this was the case, that means Hogan thought he was alone in a room with some random whore he was fucking; so that's a perfect scenario for talking shit and letting his true opinions and feelings spill out. He got too comfortable and was probably thinking "Let me relax and talk some shit; not like this bitch will tell anybody what I said, and even if she does I'll just deny it". He fucked up by assuming he wasn't being recorded, so he let the racist side come out....and the rest is history

Again....let's use common sense. If Hogan knew/remembered that he was being recorded, then in what possible scenario would it have made sense for him to let the n-word fly, and specifically talk about how he doesn't want blacks around his daughter.....knowing the shitstorm it would cause if the recording ever leaked?

There's no reason to believe he was stupid enough to do that and think there was no chance it could leak...or think that it would just get 'automatically deleted' without somebody saving it to leak or try to extort him. It's too risky, most people are smarter than that.
