I think the bird in the front doesn't have any sort of bad intentions, it simply takes a shit without caring if anyone's behind. The other penguin just happens to be lying in an unfortunate spot.
Also, I think they're gentoo penguins and the greyish guy is a juvenile that's moulting its baby feathers and getting the adult plumage. Its color probably looks weird because of that, and not because it's been getting shat on repeatedly.
