What snake species is this and is it posionous?

There are only 2 poisonous snakes so that is most likely not.

Its a garter snake, and it's harmless.

Poison is ingested(eaten), venom is injected. There're only a couple snakes that are poisonous which occurs in their flesh, but because most snake toxin only works when transferred into the blood stream, it is injected into the body.

The garter snake has been considered to be venomous, only because their bites cause just a small amount of swelling. But, it's so mild, it's pretty much considered non-venomous.

Basically Grass snakes become poisonous from eating toads while garter snakes become poisonous from eating a specific newt. Since they didn't evolve to rely on these prey items they don't naturally neutralize the toxins but rather tolerate then to the point of immunity. Which explains why other snakes like hognoses that feed primarily on toads aren't poisonous.
