This is part of why I love rule 34. It shows that nothing is sacred. No, they don't think they can remove all nintendo porn from the internet. No, they almost certainly don't even think they can actually get any judgments against people who host it. At most, they'll push a single case in a jurisdiction where they know the judges tend to be conservative enough to not make them pay legal fees. Screaming "fair use" (or putting a disclaimer that says "I know what I'm doing might be illegal cause I don't own shit" at the start) works in an internet argument, but it takes lawyers and a ton of money to put the principle to work in court. The artist would probably win as long as their lawyer wasn't shit, but it would take money, time, and the artist would be effectively doxxed. Anyone looking at what that poor bastard went through to "win" (aka just getting back to normal) will at least think twice, and that's all Nintendo wants out of this. To bully some content aggregators (tumblr et al) out of hosting it, and to hopefully intimidate some people out of creating it.

So they spend a handful of billable hours on sending out form letters and then, at absolute incredible maximum a court case. They do this so they look like they're doing something to reduce the use of their copyrighted characters to create things that make the corporate types uncomfortable. 90% of success in corporate america flows from looking like you're doing something, so it's a winning move for their legal team. It's really not a big investment and really not worth the rustling of jimmies in this thread.

As weird as Australia is, we have an awesome law that helps here.
The parody clause in the copyright act allows this kind of thing...

Fair use isn't carte blanche to do what you want, and I'm tired of people throwing the term around like that. Fanworks don't necessarily fall under fair use; it can really only be decided on a case by case basis. Historically, the only reason fanart isn't taken down is because it's rarely worth the cost to do and because companies usually don't want to kill fan good will.
