Because it's pointless. The entire show was about how revenge was a futile action. Hitei kept trying to convince Togame to give up and move on with her life, but in the end was forced to kill her because doing otherwise would be insubordination that would get them both killed. Shichika was never such an emotional person that he'd overlook that.

The whole point of the show is the stubbornly clinging to a futile ambition destroys you in every way. Togame's character is representative of this, with revenge being her sole motivator that would have led to her killing someone she loved (and she wasn't just saying that to make Shichika feel better, the sage episode is entirely devoted to this). Hitei, on the other hand, has no ambition she clings to and is just watching events as they unfold; thematically, she must live. As for why Shichika doesn't actually kill her, its because Hitei is the closest thing Togame had to a friend ("I didn't dislike her") and he recognizes that killing her would be both pointless and just add more suffering. He kills the shogun because he was the true root cause behind Togame's madness (that or just to get Cheerio! a good start).
