I don't know when you'll realize it, but there aren't many innocent people in this series, and that's mainly due to the setting. It was established from the start that AC was dark and twisted, and the magic side dealt with necessary evils. Touma's moralfaggotry was the only balance to that, but with the fucked up situations, this was a time, and make no mistake: there will more like this, where he makes a very fucking sketchy call. By the end of this series, most of the main cast will be neck high in shit they've caused, and with your logic you'll be condemning them still.

The situation is basically that Othinus had a gun to a hostage's head, the entire world, but a hostage nonetheless. From there the world sets up a sniper while negotiating for the hostage and gives the signal to kill her and isn't actually going to make good on any offers they make. From there Touma steps in front of the spot the sniper is aiming at, and asks Othinus to let the hostage go, she does, and before the world shoots her he asks that they let her surrender and go to jail for her crimes. They arrest her and she has a trial and eventually the trial says she's free to go.

The only issue here, is the bit where she gets off scot free, but it isn't Touma's fault and you really can't blame him for not marching her back to the hall of justice and asking for a retrial. Seeing as he just had a huge character arc about finally acting a bit selfish for himself and he's biased to want the best for her, so if the world decides she's free to go and he thinks she's going to atone and try her best to be her best from here on out why the hell should he complain?
