She isn't able to understand, she needs time, but she is happy. The second time is in arc 4, after a lot of things happened, and she doesn't trust him anymore again. She tells him he is a liar, and that he never loved her, and after a lot of talking, he is forced to shut up her, kissing her.
It's not a forced kiss, actually. He tells her that if she doesn't trust his words, he will show his love for her by facts. Hi face gets close to hers and he tells her "if you don't want it, well you avoid it". But she closes her eyes and she accepts the kiss. You don't even know how complicated Emilia is. The fact is that she has less self-eestem than Rem, if it's also possible, being a half-elf that everyone hates.

Also, it bears mentioning that the witch's scent gets stronger on him whenever he attempts explaining, which has prompted people to distrust him. That's enough of a hurdle on its own, but it's pretty well-established by now that Subaru takes it really fucking personally when people don't trust him. With this in mind, I'd almost say it's more in-character for him not to try these things for fear of that whole scent aspect.

This is the part just after Garfiel's defeat at the hands of Otto, Ram, Subaru, and Patrache.

Although I couldn't leave out this golden one.
When Garfiel defeated both Otto and Ram, he threatens Subaru that he ripped and tear both apart, which Subaru doesn't believe at all (Garfiel cannot kill anyone unless in full beast-form).

Subaru claims Garfiel couldn't have killed both Otto and Ram. Garfiel's reply was.
