The Shinigami did attack first. The Sternritter fled from the world of the living into Soul Society. Which means the war was fought in the world of the living. Her Shikai's stated ability is "Make shit the sword touches cold". That is ridiculously versatile. It's only for her own lack of imagination that limits it to those simple "Moves". Which we've already seen her move past, using her ability to generate earthquakes.
