Here's how it works

Giovanni - He sold Pokemon for profit, buyers could have been questionable in on themselves such as weapon dealers/developers and such.

No clemency, he's going to fucking jail

Maxie may or may not have ties to Pokemon research. The actions of Team Magma were destructive but not harmful to the Pokemon being used. Probably gets a sentence or at least will be put on a watchlist if he isn't serving jail time.

Archie is more or less the same as Maxie in terms of weight of crimes. Actions at the Mossdeep Space Center were independent of his instructions, so it's likely Matt (and Courtney in the case of Magma) will go to jail for terrorist acts on a facility associated with Pokemon research.

Cyrus would have gone to jail. Charon, Saturn, Mars and Jupiter were accomplices in actions intentionally meant to harm Pokemon as a means to an end on top of attempting an apocalypse. Jail for all of them.

Unova's justice system is far more strict. Plasma members are to be arrested on sight. Colress is exempt because his rights trump Unova's government.

Lysandre and his researchers intended harm on Pokemon. Jail time without question.

Skull gets clemency but no one knows what happened to the Pokemon they sold off. Investigation would suggest they were subject to unspeakable things at Aether. Jail time is very much probable based on that.

Everything in the Mega universe still takes place at the same relative times. ORAS remains first in the timeline, probably over a decade before XY.

Yes, there are some continuity issues with the knowledge of Mega-evolution thing. But it's fewer issues than if you had to figure out why the same series of events happened with the same people, at the same ages, but somehow 10 years later than in the other universe. It just doesn't make sense for remakes to take place at different relative times than the originals.
