Ubers was a pseudo banlist that was playable. Fug just established that there was actually a meta there, and you could make something too strong for it.
The not-Ubers/LC tiers are by usage. Randomly fitting a tier that's a banlist between two usage tiers would look weird, so I'm pretty sure smog would never actually do that.
