They take profits out of the pockets of Nintendo. Why buy Sun and Moon when you could just get Uranium and Prism for free? Nintendo should sue them for their losses, consider every download of their game is an official Pokemon game that they could've sold but didn't.

How are they not? They don't fall under any of the purpose categories (education, news, criticism), is taking from a creative work instead of a factual one, take a large and core portion of the source material, has the potential for market harm, and is not particularly transformative.

I'm all for rom hacks and other fan works, but the people that make them need to understand they are not legally protected or even favored, it's the opposite. It's like graffiti art, yeah, some of it is damn good, but the people that own the wall you sprayed have every right to remove it and possibly go after you for doing it in the first place.

Yes actually. Most forms of fan content do not have legal fair use protection. But most companies do not find things like fan art, fan fiction, etc, to be particularly problematic for them and have positive benefits such as engaging the fanbase without the company having to do so themselves. But it's easy to see how a fan game of a video game could start to breach that feeling of harmlessness in the company's perspective.

In short, the Fangame must:

*Have no financial backing what so ever (no donations, no sale).
*Clarify that said Fangame IS A FANGAME and have nothing to do with the owners of the official products.
*Cannot be a Remake by any means.

AM2R, which cause this entire fangame panic, broke rule #3.
SMBZ broke Rule #1.
So far none of the Fangames broke rule #2, but that's a given since there's always a disclaimer in every single one of those things.

I'm not counting rule 1 because the dev team didn't make any money off of Prism. Only the person who streamed the game early made money and it was the lead dev that was contacted by Nintendo.
