Excluding the gold farmers and win-traders, and there were plenty of Chinese players who were neither, there was a lot of xenophobia. But it was justified. Having a huge segment of the population be essentially unavailable for any meaningful interaction is just a bad experience. Real publishers recognize this issue and region-lock their shit rather than try to moralize to the playerbase. I realize private servers are underground affairs that don't necessarily make up for their operating costs but that doesn't change the negative impact that 'open borders' so to speak can have.

I'm hoping the Elysium staff can recognize the positive effect that banning VPNs on Kronos had for the server as a whole, but I wouldn't bet money on it.

A shutdown is caused not by Blizzard, but by the staff's decision. You do not fear some unpredictable, unstoppable death knell from on high, but how retarded, selfish, or corrupt the server staff is.

Since the lead Nost project leads have left the scene entirely, and only the devs have merged with the Elysium crew, there's a little more security. Probably, they won't do any boneheaded things like with the Nost shutdown. I doubt it will ever go under again UNTIL they start doing really dumb things, which may or may not happen.

There are servers that have successful cash shops that have been online for years.
All servers get a letter (C&D or similar) as blizzard has to do take steps to protect it's IP. However legal action past that is normally not taken for lots of reasons. You can google to see interesting arguments about it, it's not as cut and dry as one would think. The private server would certainly not be able to afford it so it's kind of a moot point, but there is the real possibility of blizzard losing.
Warmane has been up for ages and boasts about using C&D letters as toilet paper.
Nost shut down voluntarily - either to fuel the official legacy argument or because they were scared. They do not plan to shut down voluntarily this time.

Since this is getting a lot of mainstream hype, it will be interesting to see how blizzard reacts. Again, even tho it could be unlikely, there IS a chance of blizzard losing an actual case as all the server side stuff is not copyrighted and the assets used are client side. Depending on who you ask, it could be too big risk them. Also again, likely moot as no private server could afford defense costs.

The only actual court case that I can think of was vs a server based in the US that was making money off of it's players. i forget the name, however. Judgement went to blizz as the defendant never showed up.
If worse came to worse and OVH decided to start giving a shit about letters, valk would likely use a russian host.
