It's whoever went online when the game wasn't released. Nintendo told reviewers not to go online to not get banned. Those people that are banned with carts are those that broke the street date and went online. If you go online when the game is actually out then you're safe. This is just the easiest method of banning pirates.

I'm currently trying to get a stock 10.5 japanese 3ds to arm9loaderhax, and have successfully accessed the homebrew launcher via this guide:

Before I format the system and downgrade to 9.2, I would like to backup the save data of the games on the system and store them on my PC.

I have attempted to use JK save manager via the homebrew launcher, but it does not seem to detect the Japanese games on the system.
Therefore, I am looking for a save manager that supports japanese games. Apparently, there is a JK save manager .cia that has japanese game support, but I do not think I am capable of installing .cias on the system.

Does anyone know of a suitable save manager or method to backup japanese game saves?

I just went back to my O3DS and the NNID seems fine. I want to see if transfering my NNID would fix my N3DS but I was told it was a console ban.

Does that mean if I completely destroy my N3DS NNID I can't play online even as a completely new user? Because that means that I couldn't even sell my 3DS not that I'd want to.

I've been trying to either boot directly into rxTools menu from startup or from the HBL but no matter what I do nothing seems to be working.
I've got the latest version of rxtools.
I've got the firmware.bin with the exact same md5 hash.
I've made sure the firmware.bin is in the right place.
And I'm pretty fucking sure I've renamed rxtools.3dsx to boot.3dsx and back, all the while putting it inside every conceivable folder at this point.
Isn't there another way to do this?

Or should I just switch to a9lh, and is there any easy way to do that?

Why can't Nintendo check what you have installed on your system and ban consoles with homebrew apps or games that were leaked early? For that matter, how on earth does freeshop even exist? I'm just trying to wrap my head around how bad Nintendo seems to be at security.

Something odd happened to me today with the eShop and my illegitimate copy of Sun.

I heard about this massive wave of bans coming over a bunch of idiots that thought it was a good idea to wonder trade each other on copies that weren't legitimately signed. I haven't touched any kind of wireless function in my game since I started.
This morning I went to check out the eShop, in the event that I had been banned (it pays to be cautious), and everything went fine. Then, a few hours later, I go to start up my previously installed Sun and the banner says "2 days left until distribution" or something along those lines. When I tried launching it, it attempted to download an online update (I had turned my wireless off beforehand) and failed to start.

What happened here? I have no reason to believe this will result in a hardware ban because as far as I know Nintendo either has no way to see which titles you've installed to your system when launching the eshop or doesn't care (otherwise cfw'd systems would be banned left and right just for having unsigned applications on them). I just want to know how this made my Sun screwy.

Also, the eshop doesn't actually give you the game.

The eshop hands out download tickets, which you then use to get the download from their CDN. Freeshop gives you these same tickets.
The CDN just checks to see if you have the appropriate ticket. If you do, it lets you download the game.
