Because Sakurai went through all the trouble of adding Snake in Brawl and how did Kojima repay the favour? A shit port of MGS3 to the 3DS and Twin Snakes (which has good and bad things about it). If I was in Sakurai's position then I would say that's not enough for all the work I had to go through, there is a reason why Sonic came back but not Snake.
