It has double buffering vsync. Even if it drops 1 frame in a 5 second period, you'll get a drop to 20 fps. I honestly don't know why they can't just patch in triple buffering. It would fix the issue immediately.

Not enough memory to do triple buffering without impacting performance.
Anyway, it seems they completely disabled the double buffering after the patch, or they're doing nvidia's adaptive sync, because now it doesn't lock to 20fps when it drops.
