Sony never had the rights to the character

Basically Naughty Dog was renting the rights to Crash from universal since Naughty Dog developed Crash at Universal with Mark Cerny, who according to Andy and Jason was the only one there who knew what he was doing. Eventually it reached a point where Naughty Dog and Mark would develop at Naughty Dog, then send the game off to Sony only really letting universal look at the final product.

When Naughty Dog was moving into PS2 they had to decide what to do and they decided to not pay for the rights to crash, mostly because Universal wanted more say in the development process, it would cost them money for a character they had created, and they were starting to feel boxed in by Crash as a franchise and wanted to go in a new direction. So they made the most difficult decision they probably ever did and left Crash behind, but the results speak for themselves.

To add to this, Wrath of Cortex was set to be an exclusive PS2 title but then because Konami must ruin EVERYTHING, Universal made a publishing deal with Konami to publish the game for other next-gen platforms behind Sony's back basically. Sony got outraged and because they had been helping Universal develop the new Crash, they took back their code which was for an open-world platformer.
