The C&D didn't stop the game's release. It will always be available on the internet.
And, you shouldn't have a reason why Nintendo needs forgiving.

Just a reminder that trademark and copyright are not the same thing. Copyright doesn't expire if you don't defend it, and you don't even have to register a work to obtain copyright. You have it by default. Registering a work just makes it easier to defend. The one that requires some measure of protection is trademark. Trademark dilution occurs when the mark is genericized to the point that it no longer refers first to the specific thing in common usage. It seems ludicrous to even begin to entertain the notion that AM2R was a real threat to Nintendo's trademark.

There have been patches made for it by some other people. It's mostly bugfixes and adding features that the original creator had planned, such as a New Game + mode that starts the game with the lava almost completely lowered so you can go through the game in any order you want. There's also Random +, which is sort of the same thing, but with key item locations randomized.
