He's not wrong. This is part of the reason Steam have to offer refunds. A contract is not valid if a clause of it breaks the law.

For example, if they put in a EULA that they're allowed to come and kill you any time they like, would it be legal?

Because you can rollback to a previous version easily, what should become mandatory though, is devs implementing an easy system to play w/e version of the game you want like minecraft did, not always it's that simple like in the case of private servers.

The laws exist to protect consumers from shifty businessmen. Why would a contract supersede the law?

Go on Craigslist and find some retard to buy a Switch from you for $50, but they have to sign a Craigslist Purchase Agreement form which guarantees they get a working Switch and can't refund - except you also included fine print saying you are allowed to beat them within an inch of their life and take their wallet. See how that works out for you.
>>
>>379396865
not the guy you answered, but that is absolutely true.
Things you put in a contract that break the law of the country are null and void.

e.g. let's say Euthanasia is illegal in your country, even if you have a contract saying, that you want this person to kill you. It's still illegal.
or you can't buy illegal drugs even with a legit purchase contract
>>

laws exist to keep the peace and nothing more. Protection is only part of it if that's what the masses want, if they do not want it and are vocal, the laws shift and change to match society.

>or you can't buy illegal drugs even with a legit purchase contract
marijuana proves this false. It was illegal to have for decades and in the 1970s it was allowed for medical reasons but was still on the books as an illegal substance. There are also countless other laws that are excluded/overridden by what the courts agree too. Gay marriage is another great mess of that.

It's not true at all, there are exclusions all the damn time, most laws are actually not enforced and many while "legal binding" can be ignore or overlook due to certain circumstances.

A really weird case of this was when LEGO company sued Mega Bloks in 2008 for trademark infringement only to watch as the courts favored Mega Bloks even though on the books LEGO was legally in the right and should have won that suit.

actually no, most states didn't have it on the books that it was "legal" to have, it was just tolerated because the court mess of taking someones medical pot away was such a hairy mess they would rather just not deal with it. Also they afraid pushing it either way would lead to more legal issues. The law doesn't really protect people like you think it should.

Have you read what's on the books? It basically said it's still illegal and you could still be charged for having it. So all it did was put a smoking gun in your hand that would keep the police in rights to press charges on you for having it years later if they just decided you never really needed.
>>
>>379398545
No shit, but that doesn't make them not legally binding. It is still a legal document, if its not in clash with the law then it applies. If you can't provide proofs to the court that it somehow breaks one of the laws then you don't have a case.
>>
>>379399149
>"i don't know, I don't watch basketball"

>>
>>379396643
EULAs are ignored on rare occasions when they infringe on certain consumer rights based on the county the court is held.

They aren't ignored otherwise and are very often perfectly binding in legality. Declaring them to be against consumers is all well and good my fellow commie, but businesses have to protect their interests in order to keep functioning and providing their services.

In this case of the OP, it's a shit argument in most circumstances because changes in multiplayer games are well-covered in a standard EULA. Food analogies in general are horrible for videogames because it's a different industry with different expectations. If you're refunded a pizza they do so to establish good faith in hopes of more business from you. A developer likewise can assume you aren't going to buy the game again if you returned it.

Apples and oranges.

No, we are talking about funding the WHOLE thing in one purchase, since paying for the pizza was equated to funding it entirely, while paying for the game was not.
To make a better comparison with paying for a pizza, you'd be funding the download of the game by paying for it, not the development.

You talking about Radiant mode?
The optional Radiant mode?
The mode which you need to choose to play?
The mode which is described as easier than Normal?
The mode which came after the much harder Stygian mode?
That Radiant mode?

Darkest Dungeon is the worst example you could make since the devs actively put options to disable all changes introduced by updates throughout early access one by one.

>>379395878
You aren't forced to update your games. If there is a serious reason to not update then just don't fucking do it.

Don't bitch about something that is online only, because those are designed to get balance changes and other changes so if you buy it you already know it will eventually change and are not entitled to a refund.

It's like if a pizza place sold pizzas at a lower-than-average price and said "there's a small chance we'll add anchovies in 24 hours". You can eat the whole thing before then if you really hate anchovies, or you can eat as much as you can and just deal with the anchovies because you knew they were potentially coming, knowing you already got your money's worth.
>>
Man, I love anchovies.
>>
>>379399792
If you want to include preconditions for games, you're also including the cost of training the programmers, artists, etc. Which is far higher than the cost of commissioning a game. You don't duplicate pizzas like you duplicate games.

That's a shit analogy and you know it. Delivery boys never go back to your place just to add toppings. Comparing pizza delivery to video game updates is stupid. You're stupid.

I get what you're saying, and do actually think that people should have the option to update their software or not, personal freedom and whatnot, but your analogy falls short when not updating your "pizza" could potentially give someone the opportunity to access yours or someone else's pizzas and put anchovies on them against your will. I dont mind mandatory security updates if there's a genuine concern and the software is partially web-based. content patches and whatnot should never be mandatory though, and updates should always be extremely detailed so you know what's been changed. Not just "bug fixes and added stability changes" or some vague bullshit like that
>>

the pizza place specifically said they will make the pizza to your specific preference, they are obligated to fulfill that contract.

a software company makes no such guarantee.

"Marijuana" is still a Schedule ! controlled substance and is illegal under federal law. The reason you see dispensaries is due to States independently DECRIMINALIZING the substance.

This is why you keep seeing dispensaries being raided by FBI, etc;

Can't speak for Burgertown (and soon the UK) but in EU countries it isn't considered legally binding because the seller have to ensure the buyer understood and read everything and simply pressing "I read it" isn't enough since you can't guarantee that the reader understood everything.

In Germany it isn't binding because it's forced upon you after you bought a product. In Sweden it isn't binding because no one can seriously be expected to read the wall of text.
