A lot of malware is incredibly difficult to detect if you aren't dealing with something purchased by a random script kiddie.

Totally separate entity. Totally separate policy. For all intents and purposes, GoG buys the right to sell the game instead of a license to sell the game, which a developer or current right holder of an IP/franchise can not so readily just request removal of.
In other words, GoG doesn't give a shit about what a Developer wants them to do with the products they sell once they have the right to sell it.
