When did they start the bannings? My 3DS has been without any battery for probably around 6 months. In the end I couldn't care less if my 3DS actually got banned. I never used it online to begin with.

To my knowledge, it's not that simple. You have to have a legit code in order to access online again, and any code that is associated with the homebrew launcher is an issue.

Mind you, ANY code will work, so it's probably not a major issue.
