The ESRB is not a law making body. Ratings are suggestions, most stores say they abide by those suggestions for the PR. Selling an M rated game to a minor is completely legal in the US. I'm not sure about other countries, I think Australia is pretty strict about it as well as the UK.

In America, to prevent thieves, used game discs are not kept in the case but behind the counter. So if anyone manages to steal a case, they don't get the disc.

Cartridges are either behind the counter or a glass display.
