Because it's a hybrid system and a whole different beast from the 3DS. It's not like when everyone abandoned the DS after piracy started raping sales for that and they could easily move to the 3DS.

Because we are in a transitional phase. With the announcement of the new 2DS Nintendo clearly plans to keep the handheld line kicking for another year or two. It seems stupid to a lot of people here because of all the encouraged piracy, but there is still a broad selection of people who have and 3DS and don't have a Switch yet. Once the Switch is at a really comfortable userbase they will silently finish off the 3DS. But for now it is the highest selling
