The Joker unironically DOES make more sense. Batman is a billionaire who lives in a world with superhumans, and instead of using his vast fortune to better the world through philanthropy, he puts on a pair of tights and tries do the only job in his fictional universe that he is absolutely unqualified to do.
Joker's just crazy.

except the joker isn't actually crazy, if he was Batman would never be able to stop him

Wait, wut? Batman can't stop him. He just puts him in time out every few months. But that's really only because Batman is also a bit crazy and refuses to kill him despite how many lives his continued existence will inevitably cost.

Batman doesn't kill him because it isn't Batman's job to kill him.
If a court sentenced the Joker to death, do you legitimately fucking think he would intervene? Of course he wouldn't. But Gotham is the most corrupt city in fiction so he gets away with it every time. That isn't Batman's fault.

Yes, but isn't the fact that Gotham could not be trusted to take care of itself the entire reason Batman decided to become a vigilante in the first place? It's not his job to fight crime either, but he does so of his own volition. It varies, but in most iterations of the mythos, Batman is already operating outside the law simply by being Batman. He's not afraid to break the law, he's just (arguably)pathologically incapable of killing the Joker, even when it is the logical thing to do.

Batman operates outside the law only to bring otherwise untouchable criminals back to a place where the law can actually deal with them. If he was actually a lawless cunt, Gordon wouldn't work with him at all.
Killing any of the criminals would be straight up admitting he thinks he has a better view of justice than society itself, and you're looking at near totalitarianism where a bunch of superniggers get to decide who lives and dies because
>We strong, we kill bad people, unga bunga capeshit
