For example if someone is attacked without warning the attacker always has the advantage because they're striking first with the element of surprise against someone that wasn't in a fighting mindset

In a fight between two consenting untrained people, the most aggressive will probably win unless one of them has a big size advantage over the other and the fight goes to the ground

I'd say experience is the most important deciding factor, unless the size difference between the two combatants is huge.
