The movie is pretty clear that punishing Nick for his supposed crimes wouldn't make anything better for anyone. What makes things better for both him and the city is him getting some empathy and compassion.
Throwing Rosie in jail for taking advantage of the "kindness" of strangers who will give a homeless vixen a couple bucks now and then, but never a job, isn't going to benefit anyone. The city will pay for it by processing her through the prison system, and then again when she is released and still has no choice but to commit petty crime to survive.

I think Nick preferences would look more in the behaviour than the size. In bed he would be more dominant and assertive, following his Don't let them see that they got to you philosophy.
