True. Judy the Bitch and Nick the Punching Bag are the most common bad characterizations of the two but I think Nick the Incompetent pretty high up there.
Nick is often written as a lazy idiot who seemingly got where is he through sheer luck when his true character is exact the opposite. It may not be bad per se or generate abloo but it's so common that I think people don't really know the character at all.

I have to agree with >>11337997 concerning "Nick the Incompetent"; even fics that have Judy not cheating/putting down Nick/physically abusing him, many like to write Nick as a complete and utter clown who doesn't take anything seriously, is weak as hell, pawns off all of the work onto Judy, doesn't remember guidelines or protocols, etc. I am pretty sure the characterization is due to Nick's goofing off during the case/his joking at the bullpen, but people seem to forget him lugging around a giant Popsicle, having all the paperwork ready should anyone call him out on his hustles, keeping up with Judy whenever they were running and never got out of breath, etc. Nick definitely likes to joke around, but that is just how he is, and how he sometimes copes with stress.

I feel like (pre-Academy) Nick doesn't really know how to fight all that much but has a few cheap shots up his sleeves to, if not decisively end the fight, at least give him an opening big enough to slip away. Situations where he has something to prove or something to gain from winning a fight are likely extremely rare so he probably avoids violence on principle for reasons similar to what you described--he can only lose if he actually fights, so he just doesn't.

I also feel like Nick is much more comfortable talking his way out of a situation than fighting. He convinces people to buy stuff from him/sell stuff to him for a living. He is also still relatively a small animal, even if he is the biggest of small-class predators.
