1) Marvel doesn't give a shit about this stuff. The "talent" that they hire cribs, copies, traces, "references" and outright steals on a very regular basis. Due to the sheer volume of work they put out in a week they either never know, or when it is brought to their attention they write it off as an artistic "choice." I know this because I hate Greg Land on a personal level and used to bring every instance of his tracing to my boss...and every time they turned a blind eye because despite all decency in this world his shit moves units. Granted Ariel OIivetti is basically a nobody...and Marvel wouldn't mind tossing him under the bus to make a point...but they don't HAVE to do that because...

Now, i know how marvel comic artists work because I know one. It happens fairly often to people who draw for a publishing house like DC or Marvel to take direct reference for background and scenery, since usually landscapes like spiderman's are usually those of NYC. It's easier to trace a photo from any other medium and sometimes, as long as the artist actually puts in some of his own skill and design to draw the thing, it can even be accepted as a good move to save time. Heck, cartoonists don't draw everything by memory by default, that would be autistic or extremely tough. Even when they do everything first-handed, they have to take reference or else stuff will look generic 75% of the time.

This one's another thing, however. Not only the 3d models were shamelessly copypasted, but the artist didn't even try to hide it.
On yet another panel there's an alien escaping on a one-man vessel looking suspiciously like a military-coloured eldar falcon 3d model.

I can understand it if you at least try to fit it in with the rest. This guy literally added stuff that doesn't fit with his own drawing style, no wonder it's shit.

Marvel and GW won't clash, the guy will just be reprimanded.

When you're running an event every two months, ideas run low and you end up calling in a lot of pinch-hitter artists and writers. That's not even going into the almost literal autism of the writers and editors who got the job through pure nepotism.

Models are protected by Copyright. But designs and concepts aren't always.

The way I see it the Chapter House thing related to Trademarks as well. And you basically can't Trademark something you don't yet sell.

Trademarks are use it or lose it. So if I own the Trademark "Space Marines" then fail to use it to sell I will eventually lose the right to use that Trademark.

If I write rules for a model then don't get off my arse and produce said model then I can't Trademark its name.

Similarly games like Space Hulk have to be re-released once in a while so that GW can retain the name as a Trademark.

That's also why the Imperial Guard are now Astra Milliwatt and so forth. Because "Imperial Guard" can't be Trademarked.

Here's what may or may not have happened.

'Chris' is an an illustrator -among other intetests-, and a huge 40k fan. Chris is bitter and hostile toward Games Workshop for whatever reason. He knows he'd be putting GW in a difficult position by putting a slice of their IP in a widely distributed comic. Chris supposedly hates the Tau faction, so used them specifically in the hopes GW will get soured on the Tau.

Try pushing a 30 pager in a week for 6 months straight, now, a decade after the golden age of comics is passed and main market is counted from profits of declining sales. Quickest and easiest way to make a page that looks passable wins. You simply can't afford to try to be the next Miller on your weeklies and monthlies with current rates and competition.
