What do you guys think about situations like these. Where a fossil (in this case a tree) extends up through sedimentary layers. Which are supposed to take millions of years to form?
Supposedly those are select cases where it happened real quick.. So how are we supposed to know which layers are ancient and which aren't?

A few things: Trees used to have retardedly long lifespans, and before the advent of land life blooming, there were few or no natural decomposers, so forests could die standing up. Also, it's possible for a geological event such as a volcano eruption, earthquake, or landslide to encase the fossil in question in rock, setting it there.

Looks like the tree itself is hosted within a sandstone succession. Although those layers may have taken millions of years to form, it was likely much faster than that. There don't appear to be any major erosive surfaces within the succession hosting the tree. In reality sedimentation rates can be extremely rapid, particularly within a sandstone succession such as this. Look around online for articles on modern sedimentation rates if you want a reference.
Also the tree fossil likely has been silicified based on the fact that it is eroding much less rapidly than the surrounding sandstones.

I'ma offer a couple of scenarios.
1 -- Tree in swampy area that get's flooded, tree is now in an anaerobic stagnant pond bottom where it lasts for many, many years as silt slowly fills in the pond.
2 -- Tree is near volcano that erupts repeatedly, dumping multiple layers of ash over the course of weeks or months.
3 -- God is playing with you.
