You don't need to make something to patent it.
Look up "Patent trolls". There's patents for teleporters and time machines. So if one is made, the patent owner will go "Give me 50k for the patent rights or I'll sue you" and lawfully they're in the right.

You can't patent a 'time machine'. You have to patent a machine which allows for time travel.
Look up how many different patents there are for an incandescent light bulb, for instance.
For a patent to be valid, it has to describe a sufficiently unique method.
Patent trolls are not in the right, legally. It's just that the cost of defending against a patent infringement is so high that it makes more sense to just settle out of court for a few hundred thousand.
But yes, they should all be killed in painful and imaginative ways.
