Called me a missed oportunistist all you want, but i dont buy into this whole american sue and claim up melarkey for "personal injuries" caused by an accident.
I mean it was an accident and accidents happen, claim on the insurance for damages to your car but by no means sue the other person for a minor injury such as "whiplash" or " emotional distress" caused by the acident as I feel you are trying to extract blood from a stone and are essentialy...

that being said, yeah; if you're dealing with intense pain you need checked out by a doc and deep tissue damage can take 4-6 weeks to heal - or longer depending on how many muscle groups were affected

if you lose time in work you can make a civil claim against loss of earnings, and if you need specialist after-care or physio

btw you 'will' need physio if you've rekt a bunch of muscles across your shoulders, otherwise they will heal back a bit wonky and inhibit your mobility... but in the meantime instead of waiting for an appointment on monday, hit up your local A&E* and get them to xray your back

at the least you'll have medical records showing intense problems in the case where you have to make a civil claim

Hey OP, I got in an accident last year. Here is my advice

If you are in that much pain, you should go to the emergency room right away and at least they can X-ray you to make sure nothing is fractured, or maybe even broken. For all you know you could be doing more damage to yourself by not going right now. You will also want to talk to them or your doctor about getting an MRI, which is extremely important, because it will let them know exactly whats wrong. You also might get sympathy pain pills.

You should definitely inform your own insurance what happened, and that you need to go to the hospital. This way they should pay for everything, they can get reimbursed from the insurance of the lady who hit you, so its not your concern, getting to a doctor ASAP is. Same thing for the collision damage to your vehicle, although you would likely have to front the deductible in your policy, which you would get back when everything is resolved.

Another thing is you want as much advice as you can get, which your insurance can give you. If you have an relatively serious injury, such as a herniated disk, or torn shoulder, whatever, that is when you would want to consider getting a lawyer, because they will be able to negotiate the most money for you when you settle with the woman's insurance. This wont have any major impact on her life, the insurance will cover it for her, and it doesnt seem like you could go after "punitive reparations" or whatever its called, I forget. Either way though, you either want your insurance or a lawyer and her insurance to do most of the communication, its not your job, and they are probably better at it anyway.

You got her insurance information, and it's too late to call the cops. I'd personally only call them at the time of the accident if something sketchy happened, or it was really serious, for future reference. Hope you feel better and things work out

Yep ive been in multiple car accidents, both were the other drivers fault i claimed on the insurance but never sued due to whip lash, and even had a laccerstion on my head from where i head butted the window and passed out, and was out of work for a week but simply took it like a man and kept calm and carried on.
