Is it legal to have naked pictures of someone if they ask you

It's not illegal if you or someone else took the pictures with her consent as long as you don't make them public.

How would you prove to her that you deleted the pictures anyway?

Would it be illegal if I tried to black mail her? I wouldn't because the decision to split up was mutual and I have respect for her but if I did would it be illegal? For example I threatened her with making them public if she didn't give me $50 or something.
