It's worth remembering that the plaintiff also has to cover their own legal fees.

You do raise a good point though. The extremely high cost of fighting a lawsuit makes the legal system subject to abuse. If I can retain a lawyer for a few thousand dollars I can use the threat of a protracted legal battle to extort an out of court settlement from people who can't afford to defend themselves in a long lawsuit. It's a good argument toward making the loser in a civil suit cover the legal fees of the other party. Of course the flip side of that is that such a system could make people with a legitimate grievance afraid to seek legal redress if they were afraid of losing and being stuck with their adversary's legal fees. A real dilemma.
